1. INTRODUCTION

These Terms & Conditions ("Terms") govern your use of yacht charter services provided by MEDYACHTS ("we," "us," "our," or "MEDYACHTS"), a luxury yacht charter company based in Cyprus. By making a booking or using our services, you ("you," "your," or "Client") agree to be bound by these Terms.

2. SERVICES PROVIDED

MEDYACHTS offers:

  • Luxury yacht charter services (motor yachts, sailing yachts, catamarans)

  • Day and multi-day charter packages

  • Customized routes and itineraries around Cyprus and the Mediterranean

  • Professional captain and crew services

  • Catering and beverage coordination

  • Water sports and recreational equipment

  • Special event hosting on yachts

  • Concierge and support services

3. BOOKING AND RESERVATIONS

3.1 Charter Bookings

  • All charter bookings require a signed contract and deposit payment

  • Charter dates and times are confirmed only upon receipt of deposit

  • Minimum booking durations may apply for different yacht types

  • Guest capacity limits strictly enforced based on yacht specifications and safety regulations

  • Route and itinerary subject to weather conditions and captain's discretion

3.2 Booking Modifications

  • Changes to confirmed bookings subject to availability and may incur additional charges

  • Date or time changes may incur rebooking fees

  • Guest count increases beyond yacht capacity cannot be accommodated

  • Itinerary modifications must be confirmed in writing and approved by captain

  • Changes requested within 7 days of charter may incur penalty charges

4. PAYMENT TERMS

4.1 Charter Payments

  • Deposit: 20% non-refundable deposit required to confirm booking

  • Balance payment: Remaining 70% due 7 days before charter date

  • Security deposit: Refundable security deposit may be required and returned within 7 days post-charter

  • Additional charges: Extras, catering, damages, or fuel surcharges due within 7 days of invoice

4.2 Payment Methods

We accept:

  • Bank transfers

  • Credit/debit cards (processing fees may apply)

  • Cash payments (for balance payments only)

4.3 Currency

  • All prices quoted in Euros (EUR)

  • Exchange rate fluctuations may affect final pricing for foreign currency payments

  • Prices include VAT unless otherwise stated

5. CANCELLATION AND REFUND POLICY

5.1 Cancellations by Client

  • More than 30 days before charter: 70% refund of total paid amount

  • 15-30 days before charter: 50% refund of total paid amount

  • 7-14 days before charter: 25% refund of total paid amount

  • Less than 7 days before charter: No refund

  • No-show: Full charges apply with no refund

5.2 Cancellations by MEDYACHTS

  • Full refund of all payments if we cancel your booking

  • Alternative dates or yachts offered when possible

  • Compensation limited to amounts paid to MEDYACHTS

  • No liability for consequential losses, travel costs, or third-party expenses

6. WEATHER CONDITIONS AND FORCE MAJEURE

Safety is our top priority. Charter operations are subject to weather and sea conditions:

  • Captain has final authority to modify routes, shorten, or cancel charters due to weather

  • Wind speeds above 20 knots or sea conditions deemed unsafe may result in cancellation

  • Weather-related cancellations on charter day: 100% refund or alternative date offered

  • Partial weather disruptions may result in proportional refunds at captain's discretion

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including:

  • Natural disasters, extreme weather, or sea conditions

  • Government regulations, port restrictions, or travel bans

  • Public health emergencies or pandemic restrictions

  • Maritime incidents, mechanical failures beyond our control

  • War, terrorism, or civil unrest

7. GUEST CONDUCT AND YACHT RULES

7.1 General Conduct

  • All guests must comply with Cyprus maritime laws and international regulations

  • Respectful behavior toward crew, other guests, and marine environment required

  • Smoking permitted only in designated outdoor areas

  • No illegal substances or activities permitted on board

  • Guests must follow all safety instructions from captain and crew

  • Life jackets must be worn when instructed

7.2 Yacht Rules

  • Maximum capacity limits strictly enforced for safety

  • Children under 12 must wear life jackets at all times when on deck

  • No jumping or diving from yacht unless authorized by captain

  • Damage to yacht or equipment will be charged to client

  • Shoes to be removed before boarding (deck shoes acceptable)

  • Guests arrive at meeting point on time; late arrivals may reduce charter duration

7.3 Alcohol and Conduct

  • Responsible alcohol consumption expected; captain may refuse service

  • Intoxicated guests may be denied boarding or disembarked at nearest port

  • Disruptive behavior may result in charter termination without refund

8. LIABILITY AND INSURANCE

8.1 Limitation of Liability

  • Our liability is limited to the total amount paid for charter services

  • We are not liable for indirect, consequential, or special damages

  • We are not liable for personal property loss, theft, or damage

  • We are not liable for personal injury except where caused by our negligence

  • Force majeure and weather events exclude all liability

8.2 Client Responsibilities

  • Clients liable for guest behavior and any damage to yacht or equipment

  • Clients responsible for ensuring guests can swim or wear life jackets

  • Clients must disclose any medical conditions that may affect charter safety

  • Clients liable for any legal violations by guests

8.3 Insurance

  • All yachts carry comprehensive hull and liability insurance

  • Insurance does not cover client personal property or belongings

  • Clients strongly advised to maintain travel and personal insurance

  • Insurance claims must be reported within 24 hours of incident

9. HEALTH AND SAFETY

9.1 Medical Conditions

  • Guests must disclose relevant medical conditions (heart conditions, epilepsy, pregnancy, etc.)

  • Seasickness medication recommended for those prone to motion sickness

  • First aid kit available on board; serious medical issues require port return

9.2 Food Safety and Catering

  • Catering provided by approved third-party vendors

  • Dietary requirements and allergies must be communicated 48 hours in advance

  • MEDYACHTS not responsible for food preparation or allergen cross-contamination

  • Clients may bring own food and beverages with advance notice

9.3 Safety Equipment

  • All yachts equipped with life jackets, life rafts, fire extinguishers, and safety equipment

  • Emergency procedures briefing provided before departure

  • VHF radio and GPS navigation on all vessels

  • Crew trained in first aid and emergency response

10. DATA PROTECTION AND PRIVACY

  • Personal information handled according to our Privacy Policy

  • GDPR compliance for all EU residents

  • Passport/ID details required for port authorities and maritime regulations

  • Marketing communications require opt-in consent

  • Client data may be shared with necessary service providers (catering, fuel, etc.)

  • Data retention periods specified in Privacy Policy

11. PHOTOGRAPHY AND VIDEOGRAPHY

  • MEDYACHTS may photograph/film charters for marketing purposes

  • Clients will be notified and can opt-out of marketing photography

  • Social media posts featuring our yachts and services appreciated

  • Commercial photography/filming on yachts requires advance approval and may incur fees

  • Drone photography must be approved by captain and comply with aviation regulations

12. CHILDREN AND MINORS

  • Children welcome with adult supervision at all times

  • Children under 12 must wear life jackets when on deck

  • Parents/guardians fully responsible for children's safety and conduct

  • Swimming activities require parental supervision

  • Infants and toddlers accepted with advance notification

13. COMPLAINTS AND DISPUTE RESOLUTION

13.1 Complaint Procedure

  • Complaints should be reported immediately to captain or crew during charter

  • Written complaints accepted within 7 days of charter completion

  • Management team will investigate and respond within 10 business days

  • Escalation procedures available for unresolved issues

13.2 Dispute Resolution

  • Good faith negotiation preferred for dispute resolution

  • Mediation through Cyprus Tourism Organization available if required

  • Cyprus courts have exclusive jurisdiction over legal disputes

  • Cyprus law governs all contractual relationships

14. GOVERNING LAW AND JURISDICTION

  • These Terms governed by the laws of the Republic of Cyprus

  • Cyprus courts have exclusive jurisdiction over disputes

  • European Union consumer protection laws applicable where relevant

  • International maritime conventions apply where applicable

15. AMENDMENTS AND UPDATES

  • Terms may be updated to reflect changes in law or operations

  • Significant changes communicated to confirmed bookings

  • Current Terms available on website and provided with booking confirmations

  • Booking-specific terms in contracts take precedence

16. SEVERABILITY

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with your charter contract and our Privacy Policy, constitute the entire agreement between you and MEDYACHTS.
